WEBKINZ MAZIN’ HAMSTERS VIDEO CONTEST
CONTEST OPEN TO RESIDENTS OF CANADA AND THE USA (some exclusions apply).
1. These are the official rules (“Rules”) for the ‘Mazin Hamster Video Contest (the “Contest”) which is offered by Ganz (“Sponsor”). By entering, each entrant (“Entrant”) is deemed to agree with the Rules; do not enter the Contest if you do not agree to Rules. No purchase is necessary to enter the Contest.
2. The Contest begins on July 24, 2010 at 12:00 a.m. Eastern Time and ends on July 30, 2010 at 11:59 p.m. Eastern Time (”Contest Submission Period”).
3. Each Entrant must create an original YouTube Video Submission (“Submission”) with the MAZIN’ Hamsters as its subject. Submissions must adhere to YouTube’s Terms of Use, posted online at http://www.youtube.com/t/terms. . All online video Submissions must be in formats accepted by YouTube (WMV, 3GP, AVI, MOV, MP4, MPEG, FLV or MKV). The maximum file size allowable per upload is 2GB.. Submission must then be posted as a “Video Response” to the GanzVideos Contest Video – http://www.youtube.com/watch?v=K_xi5aKBLhc. Videos are subject to Sponsor’s approval before appearing as a Video Response.
4. There are two (2) Prizes available to be won consisting of: an eStore exclusive MAZIN’ Hamster Feature Code. The odds of winning a prize depend upon the number and quality of Entries received during the Contest Submission Period. Maximum one Prize per person. One Prize will be awarded for the most creative Maze and one for the most creative general video.
5. To enter online, visit www.youtube.com during the Contest Submission Period and upload your submission. Then visit www.youtube.com/ganzvideos and click on the Contest Video link (http://www.youtube.com/watch?v=K_xi5aKBLhc) to submit your video as a Video Response.
HOW TO ENTER:
6. Upload or record a new Submission, visit www.youtube.com/ganzvideos and click on the “MAZIN’ Hamster Video Contest” video. Click the text box that says “Respond to this Video” and then click the “Attach a Video” link that appears to the right and select your Submission. The uploaded Submission constitutes an entry (“Entry”) into the Contest. Entries are subject to screening by Sponsor prior to appearing as a Video Response to the official Contest Video. Submissions must appear as a Video Response to qualify for a Prize. If you do not have access to the Internet and wish to enter online please inquire with your local library to see if they provide Internet access or visit an Internet Café.
7. A maximum of one (1) Entry, by any method, is allowed per person during the entire Contest Submission Period. If the Sponsor determines that an Entrant has attempted to enter more than one (1) time combined by any method, all Entries from that person will be void. Entries become the property of the Sponsor and none will be returned. Entries will be rejected if they are not fully completed, received by the Sponsor outside of the Contest Submission Period, or do not comply with these Contest Rules, or the Website’s terms of use and policies, as determined in the sole and final discretion of the Sponsor.
SUBMISSION REQUIREMENTS:
8. Each Entry must include an original Submission. By entering the Submission, the Entrant represents and warrants that: (a) the Submission is an original creation of the Entrant and does not include or incorporate, in any manner, any work that was created and/or owned by a third party, other than with all legal consents necessary for the use of such work in connection with the Entry to this Contest; (b) the Submission is not libelous, defamatory, profane or obscene and does not infringe upon the intellectual property rights, rights of privacy or personality or any other statutory or common law rights of any other person; (c) Entrant has obtained the consent of all necessary parties (or their parent or legal guardian of any individual under the age of majority) whose work or image is included in the Submission for it to be included in the Submission, for display to the public online, for the Entrant to assign all intellectual property rights in the Submission to the Sponsor, and to waive all moral rights in and to any part of the Submission. If the Entrant is a child under the age of 18, his or her parent or legal guardian warrants that such parent or legal guardian has read and consents to the Contest Rules before any Submission is sent to Sponsor.
9. By uploading the Submission, each Entrant (and Entrant’s parents/legal guardians, if Entrant is under the age of 18) grants Sponsor a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology (now known or later developed or devised) throughout the world. In addition, each Entrant waives any “moral rights” in those materials. Each Entrant also represents that any materials submitted are original works and do not infringe the rights of any third parties. You also waive all recourse against the Sponsor, its partners, affiliates, directors, officers, employees, agents and servants, and its advertising and promotional agencies relating to any prize or the Submission or participation in the Contest.
ELIGIBILITY:
10. This Contest is open to residents of Canada and the USA who have reached the age of majority in their province or territory of residence at the time of Entry. If the participant is a child under the age of the majority, his or her Entry must be submitted by his/her parent or legal guardian. Residents of the Province of Quebec, States of New York and Florida are excluded from participation in this Contest.
11. You are not eligible if you are an employee of Sponsor, its partners, affiliates, subsidiaries or related companies, advertising or promotional agencies or a member of the immediate family of any such employee. For these Rules, “immediate family” includes spouse, mother, father, sisters, brothers, sons and daughters, whether living in the same household or not.
PRIZES:
12. Delivery of the Prizes will be to the Winner’s YouTube Account submitted during the registration process, as indicated in his/her Entry, not less than thirty (30) days of being declared a Winner. All Prizes must be activated by the Winner on www.webkinz.com within sixty (60) days of the award or they will be forfeited with no liability whatsoever to the Sponsor, its partners, affiliates, subsidiaries or related companies and its advertising or promotional agencies.
13. Prizes must be accepted as awarded. Sponsor reserves the right in its sole discretion to substitute a prize or prize component of equal or greater value. The odds of winning a prize depend upon the number and quality of Entries received during the Contest Submission Period. Maximum one prize per person.
WINNER SELECTION:
14. The most creative Maze and the most creative general video Submissions will be selected as the winners. Submissions must appear as a Video Response to the official contest video to be eligible. A panel of judges appointed by the Sponsor (”Judging Panel”) will determine the winners at the end of the Submission Period and will make final judgment based on originality and creativity. Entries that do not comply with these Rules as determined solely by the Sponsor will be disqualified.
15. No correspondence will be entered into except with the Winners. The decisions of the Judging Panel are final and binding on all Entrants without right of appeal.
16. By entering this Contest, each Entrant: (i) grants to the Sponsor the right to use his/her name, mailing address, telephone number, e-mail address and any personal information contained in or related to the Submission/Entry (the “Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and publicizing the identity of the Winners; (ii) grants to the Sponsor the right to use his/her Personal Information for any publicity and promotional purposes relating to the Contest or otherwise by the Sponsor, in any and all media now known or hereafter devised, including print, broadcast or the Internet, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to any of its third-party agents or service providers in connection with any of the activities identified in (i) and (ii) above. The Sponsor will use the Personal Information for identified purposes only and in a manner that is consistent with its Privacy Policy, posted on www.kinzvillenewz.com.
17. By accepting a Prize, each winner (“Winner”) agrees that his/her Submission may be published on/transmitted through a website of the Sponsor and used in any of its future designs, advertising, promotions and public relations initiatives without consent, approval of further compensation. In addition, each Winner is deemed to agree to the use, without compensation, of his/her image, statements about the Contest, name and city of residence in any publicity campaigns related to the Contest or the Sponsor generally.
18. If a dispute arises regarding the identity of an Entrant or ownership of a Submission, the Entry will be deemed to be submitted by the authorized account holder of the YouTube account provided at the time of Entry. “Authorized Account Holder” shall be the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
GENERAL:
19. Sponsor reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest and/or the Rules in any way, at any time, for any reason without prior notice.
20. By entering this Contest, Entrants acknowledge that all Entries (including all Submissions) become the property of Sponsor and will not be returned. Sponsor may at its sole discretion select a number of Entries and post them on a website, as is, or as they may be edited in Sponsor’s sole discretion.
21. The Sponsor assumes no responsibility for incomplete, lost, stolen, delayed, or postage-due Entries or damaged or misdirected entries or for any failure of any website, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any Entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from up-loading or down-loading any material in connection with the Contest.
22. Entries are subject to verification. Entries that are irregular, have been submitted through unapproved means, or which do not otherwise conform with or satisfy any or all conditions of these Rules will be void. By entering, each Entrant agrees to abide by these Rules and the decisions of the Sponsor which shall be final and binding in all matters related to the Contest.
23. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited by law. All issues and questions concerning the Contest, the interpretation of the Contest Rules or the rights and obligations of Entrants and the Sponsor shall be governed and construed in accordance with the laws of the province of Ontario and federal laws applicable therein excluding any rule or principle of conflicts of law that may provide otherwise. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
24. All intellectual property, including but not limited to trade marks, trade names, logos, web pages and promotional materials are owned by the Sponsor or its licensors. All rights are reserved. Any unauthorized reproduction of any intellectual property without the express written consent of its owner is strictly prohibited.
